News reports are exposing USA Swimming's years of coaching molestation cover-ups. Tim Joyce of WBAL reports that USA Swimming, "is, at best, a saga of institutional failure and moral bankruptcy and, at worst, a covering-up of abuse that may lead to criminal investigations of USA Swimming officials".
Journalist Irv Muchnick reports on the widespread sex abuse of young female swimmers and states, "Perhaps most troubling of all is evidence that a culture of denial still persists at the highest levels of the sport".
Meanwhile, The law firms of Corsiglia, McMahon & Allard of San Jose, California, and Shamberg, Johnson and Bergman in Kansas City, Missouri, are announcing that the California State Supreme Court on Friday denied USA Swimming's request to keep confidential the last twenty years of sexual molestation complaints filed against its coaches. In denying the petition for review, the State Supreme Court refused to hear USA Swimming's appeal of a lower court decision that ordered the organization to turn over twenty years of coaching molestation records without redactions. Since the Supreme Court has denied the petition for review, the Court of Appeal ruling governs the case and further appeal in a California state court is not allowed.
The two law firms represent plaintiff Jancy Thompson in a case seeking monetary damages for the alleged sexual abuse and molestation by USA Swimming certified Coach Norm Havercroft that the lawsuit claims could have been prevented by USA Swimming. In the Jancy Thompson case USA Swimming has now lost four times and in the Jane Doe case they lost three motions before the case settled.
Attorney Robert Allard does not expect to see the documents until October. "The amount of time and money that has been spent over the last
3 years to hide these documents has been extraordinary. They sought relief from the court a whopping seven times and have embarrassed themselves by losing every time and getting sanctioned in the process.
This has resulted in a complete waste of hard earned monies paid by the USA Swimming membership. If the leaders of this organization would just stop shielding the truth, everyone would be better off, except, of course, the pedophile coaches that they are going to such great lengths to protect. The whole situation is another chapter in a sad tale of greed and corruption stemming from corporate power. How much more will this membership tolerate?"
