GUANGZHOU, China (AP) ? A Chinese court on Wednesday began hearing Apple's appeal of a ruling against its right to use the iPad trademark in China.
Apple Inc. is in several legal battles with Proview Electronics Co., which the U.S. company says sold it the rights to the iPad trademark in 10 different countries, including China, in 2009. Apple contends that Proview has refused to honor the agreement and has not indicated any willingness to settle with Proview, a maker of computer monitors and LED lights.
Walking into the Guangdong High Court in the southern Chinese city of Guangzhou on Wednesday, lawyers for Proview expressed confidence, but also indicated the company remained open to settling with Apple.
"I don't rule out the possibility," Xie Xianghui, a lawyer representing Shenzhen Proview Technology, the company's main Chinese subsidiary, told reporters.
On Tuesday, Proview announced it was seeking to regain worldwide rights to the iPad name and is suing Apple Inc. in the U.S. for alleged fraud and unfair competition, hoping to have a 2009 sale of the trademark ruled void. Proview was previously only claiming rights to the iPad name in China.
Apart from having the trademark sale voided, it also is seeking unspecified compensation, a share of Apple's profits from alleged "unfair competition" and an order for Apple to stop using the trademarks.
So far, two lower courts in Guangdong have sided with Proview on the issue, while a Hong Kong court ruled in Apple's favor. Last week, Shanghai's High Court rejected Proview's effort to get Apple to stop selling the popular tablet computer under the iPad name.
Proview, once a major computer monitor manufacturer, launched a device it called iPAD, or Internet Personal Access Device, in 2000 but it was not a market hit. Apple launched its popular iPad tablet in 2010.
Proview contends Apple intentionally misled it when it bought iPad trademarks through a special purpose company called IP Application Development Ltd. that concealed it was acting on Apple's behalf.
Experts in the high-tech field say such tactics are common given the secrecy surrounding new product launches, especially Apple's.

He was very close to publishing his theory of evolution by the 1840s and was keenly aware of the abuse given to Lamarck?s theories. In 1844, Robert Chambers anonymously published a book titled?Vestiges of the Natural History of Creation which was written in a style, and priced, for the lay person. It became very popular and laid his own theory for evolution built upon Lamarckian ideas.?Vestiges purported a linear chain of transmutation culminating in man ? more specifically, a white English man.
While popular with the laity, the academics and clergy who mentored Charles, and whose approval he often sought, were up in arms about the book and its rampant attacks against Natural Theology, the prevailing?modus operandi in the natural history community of the time. It was because of this that botanist John Hooker, a friend and confidant, wrote Darwin after reading a draft of his ?big species paper?:
?Do not think I meant to insinuate that you could not be a judge from not having worked out species, for your having collected with judgement is working out species: what I meant I still maintain, that to be able to handle the subject at all, one must have handled hundreds of species with a view to distinguishing them & that over a great part,?or brought from a great many parts,?of the globe.? ? Hooker in a letter to Darwin 14 September, 1845
This frightened Charles, as he was not inclined to disappoint or scientifically alienate himself from his beloved colleagues. While it is arguable that Hooker?s letter set back Darwin?s publication of his ideas, it encouraged him to intimately study several larger aspects of morphology that would inevitably aide him in cementing his theory of evolution by natural selection.

Darwin had been working on a problematic barnacle collected during the?Beagle voyage since 1835 he? called ?Mr. Arthrobalanus? (left). Beginning in 1846, barnacles would consume his family?s life for the following 8 years resulting in 4 volumes of living and fossil barnacles of all known types from around the world during that time. Charles? son Francis would famously ask of another child, ?where does you father do his barnacles??
It was not until 1830 that it was realized barnacles were crustaceans. Since they were shelled creatures, naturalists had considered them mollusks akin to mussels, snails and limpets. John Thompson followed the embryology and metamorphosis of barnacles and determined by their developmental characteristics that they were actually closely aligned to the crustaceans. Mollusks weren?t considered a metamorphosing species to Victorian naturalists.
The basic concept that Darwin wrapped his barnacle synthesis around ? and even more so later in his?Origin -?was Richard Owen?s homology concept, meaning that characters were derived from shared ancestry. Owen was a powerful colleague and former mentor of sorts to Charles. Darwin had much respect for him and tried to work within Owen?s ?archetype? framework, which was initially developed with vertebrates in mind. The archetype was a theoretical ancestor, a blueprint in the mind of the ?creator?. Owen did not necessarily believe it existed but nonetheless thought it was a useful construct from which to understand his homology framework. Darwin, working within the archetype framework for barnacles, was able to systematically classify everything and place Cirripedia correctly as a subclass of the Crustacea, confirming Thompson?s earlier embryological observations.
One of the more interesting challenges to Darwin?s classification of barnacles was the issue of small ?complimentary males?, as he called them. Not only did these dwarf males attach to the female, but some species had hermaphrodites with attached dwarf males as well! Because Charles was working within Owen?s homology paradigm, he viewed hermaphroditism as a major character in his barnacle classification and made some interesting, though erroneous, inferences. In his Victorian worldview, Darwin naturally saw the condition of having separate sexes as the most ?highly evolved? state, while rampant hermaphroditism must surely be the basal condition. But these curious parasitic dwarf males must be a transitional state between a hermaphroditic ancestor and the more ?dignified? separation of sexes.
?These parasites, I now can show, are supplemental males, the male organs in the hermaphrodite being unusually small, though perfect & containing zoosperms: so we have almost a polygamous animal, simple females alone being wanting. I never shd. have made this out, had not my species theory convinced me, that an hermaphrodite species must pass into a bisexual species by insensibly small stages, & here we have it, for the male organs in the hermaphrodite are beginning to fail, & independent males ready formed.? ? BEIRUT (AP) ? Government troops shelled rebel-held areas in central Syria on Friday, killing at least four people, activists said, as the United States, Europe and Arab nations met in Tunisia to seek ways to end President Bashar Assad's crackdown on an 11-month uprising against his rule.
As government troops continued to pound rebel-held neighborhoods in the besieged city of Homs, thousands of people in dozens of towns across Syria staged anti-regime protests under the slogan: "We will revolt for your sake, Baba Amr," referring to the besieged Homs neighborhood that has become the center of the Syrian revolt.
More than 70 countries are taking part in Friday's "Friends of Syria" meeting, which is expected to press Assad to agree to a cease-fire and allow for humanitarian aid to reach the areas that have been hardest-hit by his security forces.
American, European and Arab officials have said the group would likely impose harsher sanctions if Assad rejects the cease-fire, and predicted the regime's opponents would grow stronger if Assad remained in power.
Diplomatic efforts to resolve the crisis gained pace Thursday with the appointment of former U.N. secretary-general Kofi Annan as the joint United Nations-Arab League envoy on the Syrian crisis.
Annan said in a statement Friday that he would try to "help bring an end to the violence and human rights abuses, and promote a peaceful solution" in Syria. He expressed hope the Syrian government and opposition groups will cooperate with him in his efforts.
The Tunisia meeting is the latest international effort to end the crisis, which began when protesters, inspired by the Arab Spring uprisings elsewhere, took the streets in some of Syria's impoverished provinces nearly a year ago to call for political change.
Since then, Assad's security forces have lauched a fierce crackdown on the uprising, blaming it on Islamic extremists and armed gangs. The opposition, boosted by army defectors, has increasingly taken up arms against the regime.
The U.N. estimated in January that 5,400 people had been killed in the conflict in 2011. Hundreds more have died since. Syrian activists say the death toll is more than 7,300. Overall figures cannot be independently confirmed because Syria has prevented most media from operating inside the country.
Also Friday, U.N.-appointed investigators in Geneva said they had compiled a list of Syrian officials accused of crimes against humanity in the crackdown. The list reaches as high as Assad.
While the U.S., EU and Arab League have ratched up the pressure on Assad, Russia and China have opposed foreign intervention or sanctions against Syria.
Alexei Pushkov, a Russian lawmaker, said Friday that in his recent meeting with Assad the Syrian president sounded confident and showed no sign he would he step aside. Pushkov warned that arming the Syrian opposition would fuel civil war.
"Assad doesn't look like a person ready to leave, because, among other things, there is no reason for him to do that as he is being supported by broad layers of the population," Pushkov said, according to the RIA-Novosti news agency.
Syrians demonstrating Friday condemned the positions of Russia, China and Iran ? countries whose governments have stood by the Assad regime.
"Iranian and Russian bullets are tearing apart our bodies," read a large banner unfurled in the town of Tibet el-Imam just north of the central city of Hama.
But in a move highlighting Assad's deepening isolation, the Hamas prime minister of Gaza voiced support for Syrian protesters seeking to overthrow his regime. It was the first time that a senior Hamas figure has publicly backed the uprising and rebuked the Syrian regime.
"We commend the brave Syrian people that are moving toward democracy and reform," Ismail Haniyeh told congregants after Friday prayers in Egypt's Al-Azhar Mosque, the country's pre-eminent Islamic institution.
Assad has long hosted and supported leaders of the Hamas movement, which rules Gaza, but the group has significantly reduced the presence of its exiled leaders in Syria in the wake of protests.
Four people died Friday in the renewed shelling of the Baba Amr neighborhood of Homs, activists said, the latest of hundreds killed there in recent weeks. The neighborhood, under siege and intense shelling for three weeks, has become the center of the revolt.

JUNEAU, Alaska (AP) ? Current and former aides to Sarah Palin lashed out Wednesday at HBO's "Game Change," describing the upcoming film's depictions of her on the 2008 campaign trail as "sick" and inaccurate.
None of the aides said they have yet seen the movie, which debuts March 10, and some said they had asked for an opportunity to screen the film but had been denied.
Trailers for the film, which is based on the bestselling book chronicling the 2008 presidential race, have been released, however, and some snippets appear to cast Palin in an unfavorable light. And yet look with your own eyes at what she and her family have endured and inspired over the last few years. Any lesser man would have hanged himself by now. So who's weak?"
Recher noted that Palin wasn't the primary focus of the book, and he said he told screenwriter and co-executive producer Danny Strong that the book "absolutely, unequivocally" did not accurately reflect his time with the McCain campaign.
Filmmakers have said that they sought historical accuracy.
Director Jay Roach last month said he wrote a long letter to Palin seeking an interview with her to help the film, "but I got a very quick email back from her attorney saying, 'I checked, she declined.'"
Strong, in an email, acknowledged that members of Palin's camp asked to screen the film but said filmmakers responded that they would privately screen the movie for Palin and her husband. He said Sarah Palin declined the offer.
The film portrays Palin "in a balanced light," he said, "showing her strengths and weaknesses as the vice presidential candidate."
In addition to the book, Strong said the movie is also based on 25 interviews conducted with members of the campaign by himself and Roach. He said secondary sources include Sarah Palin's book "Going Rogue," other books written on the campaign and "innumerable" newspaper and magazine articles.
Palin did not participate in Wednesday's call. Tim Crawford, the treasurer of the political action committee SarahPAC, who facilitated the call, said Palin is on the record as considering the movie a false narrative, and wrote about her experiences in one of her books.

Micronutrients affect methylation, which has been associated with changes in the immune system
The offspring of women who were given micronutrient supplements (minerals needed in small quantities, such as iron, iodine and vitamin A) before they became pregnant had gene modifications at birth as well as when they were tested at 9 months.
The changes to the genes, called methylation, have previously been associated with the development of the immune system, although this study did not provide direct evidence that the activity of these genes has changed. The research, funded by the BBSRC, was published today in the journal Human Molecular Genetics in advance online publication (DOI number DDS026).
Professor Nabeel Affara, lead author of the study from the University of Cambridge, said: "The mechanism by which micronutrients influence methylation changes is still to be worked out, but it is known from other work that the genes of the immune system undergo such changes as immune function develops, particularly in early postnatal stages and early childhood.
"These changes are part of the normal development of the immune system provided adequate nutrition is available. Where this is not the case, different patterns of methylation may occur, altering the activity of key genes and therefore potentially the effectiveness of the immune system. The result is likely to be reduced ability to fight infection and hence susceptibility to infectious diseases."
The study used DNA samples from a Medical Research Council (MRC) micronutrient supplementation trial where women attempting to get pregnant are given either a cocktail of micronutrients or a placebo until pregnancy is confirmed (approximately an 8 weeks period). The research was conducted in The Gambia where there is seasonal variation in the availability of micronutrients with an alternation between the dry season (when they harvest and food is plentiful) and the wet season (when there is less food available and therefore poorer nutrition). Individuals born in the wet, nutritionally poor season have been found to be more susceptible to infection.
Professor Affara added: "This has huge public health implications for regions of the world where food security is an issue. If we have an improved understanding of what nutrition is important and the mechanisms by which this important environmental factor interacts with gene function, we can target nutritional intervention to improve health in later life."
